  1. Acceptance of These Terms

    These Terms and Conditions (the "Terms") govern access to and use of the Joseph Ribkoff website and online store, including browsing the website, creating an account, placing an order, purchasing products, using customer service channels, initiating returns and otherwise interacting with the online store.

    By accessing the website, creating an account, placing an order or using any service made available through the website, the customer acknowledges that they have read, understood and agree to be bound by these Terms and by all policies referenced in these Terms, including the Privacy Policy, Cookie Policy, Shipping Policy and Return Policy.

    If a customer does not agree to these Terms, the customer should not access or use the website, create an account or place an order.

    Joseph Ribkoff may modify these Terms from time to time. The version of the Terms published on the website at the time an order is placed will apply to that order, unless otherwise required by applicable law.

  2. Definitions
    • "Customer" means an individual consumer who accesses the website, creates an account, places an order or purchases products for personal use.
    • "Global-e" means Global-e or its applicable affiliated entity acting as Merchant of Record or supporting localized international eCommerce transactions, where applicable.
    • "Joseph Ribkoff", "we", "us" and "our" mean Joseph Ribkoff Inc., or Joseph Ribkoff USA Inc. for sale within the United States of America (as applicable based on context), unless the context requires otherwise.
    • "Merchant of Record" means the entity legally responsible for processing the customer transaction, including payment collection and certain tax, duty and compliance responsibilities.
    • "Order" means a customer request to purchase one or more products through the website.
    • "Products" means Joseph Ribkoff products offered for sale through the website.
    • "Returns Portal" means the online returns experience used by customers to initiate eligible returns, currently expected to be supported through Global-e.
    • "Website" means the Joseph Ribkoff consumer eCommerce website and any related pages, checkout flow, account areas and online services.

  3. About Joseph Ribkoff

    Joseph Ribkoff Inc. is a Canadian fashion company headquartered in Montreal, Quebec, Canada. Joseph Ribkoff designs, markets and sells fashion products under the Joseph Ribkoff brand.

    Through the DTC eCommerce website, Joseph Ribkoff offers customers in supported markets the ability to browse and purchase authentic Joseph Ribkoff products for personal use. Product offering, pricing, language, currency, delivery options and return options may vary by market.

  4. Merchant of Record

    Joseph Ribkoff has partnered with Global-e to provide customers with a localized shopping experience.

    Global-e or one of its affiliated entities may act as the Merchant of Record ("Merchant of Record") for the transaction. Where Global-e acts as the Merchant of Record, it is responsible for processing customer payments, calculating and collecting applicable taxes and duties, managing payment compliance obligations, and facilitating refunds in accordance with applicable laws and its Terms and Conditions.

    Joseph Ribkoff remains responsible for the Joseph Ribkoff brand, product assortment, product quality, order fulfillment, customer experience, and customer support.

  5. Eligibility to Purchase

    The website is intended for use by consumers purchasing products for personal, non-commercial use. By placing an order, the customer confirms that they are purchasing products for personal use and not for resale, distribution or unauthorized commercial purposes.

    To place an order through the website, customers must be at least the age of majority in their jurisdiction, have the legal capacity to enter into a binding agreement, provide accurate and complete information and comply with these Terms.

    Joseph Ribkoff and/or its Merchant of Record partner reserve the right to refuse, cancel or limit any order where resale activity, fraud, abuse, policy circumvention, misuse of promotions or unauthorized commercial activity is suspected.

  6. Customer Accounts

    Customers may be able to create an account on the website to access certain features, manage preferences, view order information or support a more personalized shopping experience.

    Customers are responsible for maintaining the confidentiality of their account credentials and for all activity that occurs under their account. Customers should notify Customer Care promptly if they believe their account has been accessed without authorization.

    Joseph Ribkoff may suspend or disable an account if it reasonably believes that the account is being misused, used for fraudulent activity, used in breach of these Terms or used in a way that may harm Joseph Ribkoff, customers or service providers.

  7. Products and Availability

    Joseph Ribkoff makes reasonable efforts to ensure that product descriptions, images, colors, sizes, prices and availability displayed on the website are accurate and up to date. However, the website may contain errors, omissions or delays in updating product information.

    Actual product colors may vary depending on photography, lighting, screen display, device settings and other technical factors. Product images are provided for reference and may not perfectly reflect the final product received.

    Product availability is subject to change without notice. A product displayed on the website is not guaranteed to be available until the order has been accepted and confirmed. Joseph Ribkoff may limit quantities, discontinue products, remove products from sale or cancel orders for products that are unavailable.

    Assortment may vary by market. Products available in one market may not be available in another market, and products available through the DTC website may differ from products available through wholesale partners or other sales channels.

  8. Pricing, Taxes and Duties

    All prices displayed on the website are shown in the currency applicable to the customer’s selected shopping destination.

    For customers purchasing within Europe, the prices displayed include applicable Value Added Tax (VAT). Where applicable, duties and import charges are included in the final price presented at checkout, allowing customers to see the total amount payable before completing their purchase.

    For customers purchasing within the United States of America, the website is intended to serve customers with delivery addresses within the United States of America only. As such, import duties and cross-border taxes do not apply. Applicable U.S. state and local sales taxes will be calculated and added during checkout based on the customer’s shipping destination.

    Joseph Ribkoff and/or its Merchant of Record partner reserve the right to correct pricing errors at any time. If a pricing error is identified after an order has been placed, the order may be cancelled and a full refund issued.

    Prices, taxes, duties, shipping charges and other applicable amounts may be displayed during checkout before the customer completes the purchase. The customer is responsible for reviewing the full order total before submitting the order.

    Pricing, taxes and duties displayed during checkout are determined by the Merchant of Record in accordance with the customer's shipping destination and applicable laws.

  9. Payments and Fraud Screening

    Payment methods available at checkout may vary by country and may include major credit cards, debit cards, digital wallets and other locally available payment methods.

    Where Global-e acts as the Merchant of Record, payments are securely processed by Global-e or its authorized payment service providers.

    Global-e is responsible for:

    • payment authorization;
    • payment processing;
    • fraud prevention screening;
    • payment compliance;
    • collection of applicable taxes and duties where required.


    Customers are responsible for providing complete, current and accurate billing information when placing an order.

    Customers are also responsible for any fees charged by their financial institution, card issuer or payment provider that are separate from the purchase price displayed during checkout.

  10. Order Placement and Acceptance

    When a customer places an order through the website, the order constitutes an offer to purchase the products listed in the order, subject to these Terms and any additional terms presented during checkout.

    After an order is placed, the customer may receive an order acknowledgement by email. This acknowledgement confirms that the order request has been received but does not necessarily constitute acceptance of the order.

    An order is accepted only once it has been confirmed and prepared for shipment, or at such other point as may be specified in the final legal wording or checkout terms. 

    Orders are subject to acceptance by Joseph Ribkoff and/or Global-e, where Global-e acts as the Merchant of Record. 

    An order acknowledgement confirms only that the order has been received. Acceptance occurs once the order has been confirmed for processing. 

    Orders may be refused or cancelled for reasons including, but not limited to: 

    • product unavailability;
    • pricing errors;
    • payment authorization failure;
    • suspected fraudulent or unauthorized activity;
    • shipping restrictions;
    • legal or regulatory requirements;
    • any other reason permitted under applicable law.

    Where payment has already been collected for a cancelled order, an appropriate refund will be processed.

  11. Shipping and Delivery

    Joseph Ribkoff ships to selected destinations. Shipping methods, delivery estimates, shipping charges, and any applicable restrictions vary by market and are described in our Shipping Policy. By placing an order, you agree to the applicable Shipping Policy.

    Orders are shipped to supported delivery destinations only. Available shipping destinations, shipping methods, estimated delivery times and shipping costs may vary by market and will be presented during checkout where applicable. 

    Joseph Ribkoff is responsible for preparing and fulfilling accepted orders through its authorized logistics partners. At launch, all customer orders will be fulfilled by Joseph Ribkoff's authorized logistics partner, SEKO Logistics. Joseph Ribkoff reserves the right to change or add fulfillment partners without prior notice as its Direct-to-Consumer operating model evolves. 

    Orders may be delivered by third-party carriers selected directly or indirectly by Joseph Ribkoff, Global-e, SEKO Logistics, or another authorized service provider. Delivery services may be subject to the applicable carrier's terms, service levels and operational restrictions. 

    Estimated delivery dates are provided for informational purposes only and are not guaranteed. Delivery times may vary depending on the shipping destination, carrier performance, customs processing (where applicable), weather conditions, public holidays, operational issues, or other circumstances beyond Joseph Ribkoff's reasonable control. 

    Customers are responsible for providing complete, accurate and up-to-date shipping information. Joseph Ribkoff is not responsible for delays, failed deliveries, returned shipments, lost packages or additional charges resulting from inaccurate, incomplete or outdated shipping information provided by the customer. 

    If a shipment is returned due to an incorrect address, failed delivery attempts, refusal of delivery or failure to collect the shipment, additional shipping charges, return fees or other restrictions may apply, subject to applicable law and the applicable carrier's policies. 

  12. Order Cancellations

    Customers may request cancellation of an order prior to shipment by contacting Customer Service. 

    Cancellation requests are subject to confirmation that the order has not entered the fulfillment process. 

    Once an order has shipped, it can no longer be cancelled and must instead follow the applicable Return Policy. 

    Where Global-e acts as the Merchant of Record, any payment reversal associated with an approved cancellation will be processed in accordance with Global-e's payment procedures. 

  13. Standard Return Policy

    Joseph Ribkoff offers a commercial return policy allowing eligible products to be returned within thirty (30) days of delivery, subject to the conditions below and any additional return rules presented at the time of purchase. 

    To be eligible for return, products must be unworn, unwashed, unaltered, undamaged, have all original tags attached, be returned in original packaging where applicable and show no signs of use, damage or misuse. 

    Returns must be initiated through the Global-e Returns Portal or, where applicable, by contacting Joseph Ribkoff Customer Service. 

    Returned merchandise will be inspected upon receipt before a refund is approved. 

    Joseph Ribkoff reserves the right to reject returns that do not meet the return requirements. Certain items may be excluded from return, including final sale items, promotional items, altered items, worn items or any other products identified as non-returnable at the time of purchase. 

    Return shipping fees may apply depending on the customer's market. Applicable return shipping fees are disclosed before the customer completes their purchase and are further described in the applicable Return Policy. 

    Returns are governed by the Joseph Ribkoff Return & Refund Policy, which forms part of these Terms. By placing an order, you acknowledge and agree to the applicable Return & Refund Policy.

  14. European Union Right of Withdrawal

    Customers residing in the European Union may benefit from a statutory right of withdrawal. Where applicable, eligible EU customers may withdraw from their purchase within fourteen (14) calendar days following delivery without providing a reason. 

    Where required by applicable law, the product purchase price and the original standard outbound shipping cost will be refunded. Return shipping costs may remain the responsibility of the customer where legally permitted and clearly disclosed. 

    The statutory withdrawal right is separate from Joseph Ribkoff’s commercial thirty (30) day return policy. If both the statutory withdrawal right and the commercial return policy are available, the customer may benefit from the rights available under applicable law and the applicable policy terms. 

    Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded or restricted. 

  15. Refunds

    Once returned merchandise has been received and inspected, eligible refunds will be processed to the original method of payment, unless otherwise required by applicable law or specified by the Merchant of Record. 

    Refund processing times may vary depending on the payment provider, financial institution, country and operational processing time. Joseph Ribkoff may communicate an estimated refund timing to customers, but actual posting times may vary by bank or payment provider. 

    If returned merchandise does not meet the return conditions, the refund may be refused. In such cases, Customer Care may contact the customer regarding next steps, which may include return of the product to the customer where applicable and permitted. 

    Under Joseph Ribkoff's standard Return Policy, only the purchase price of eligible returned products will be refunded. Original shipping charges, duties, taxes and return shipping fees are not refundable unless required by applicable law. Return shipping costs remain the responsibility of the customer and will not be refunded, including where a customer exercises a statutory right of withdrawal, unless otherwise required by applicable law.

    The return label fee will be deducted from available refunds. Customers will be charged for the return label only when the refunds don't cover the fee or there are no available refunds.

    Refunds are governed by the Joseph Ribkoff Return & Refund Policy, which forms part of these Terms. By placing an order, you acknowledge and agree to the applicable Refund Policy.

  16. Promotions and Discount Codes

    Promotions, discount codes, special offers, gifts with purchase, free shipping offers and similar marketing offers are subject to their individual terms and conditions. 

    Unless otherwise stated, promotions cannot be combined, may apply only to selected products or markets, may be limited to specific customer segments, may be subject to minimum purchase amounts and may expire at the time indicated in the promotional materials. 

    Joseph Ribkoff reserves the right to modify, suspend, cancel or refuse any promotion, discount code or offer resulting from fraud, misuse, technical error, pricing error, unauthorized distribution or violation of promotion terms. 

    Promotions have no cash value and cannot be applied retroactively unless expressly stated. 

  17. Gift Cards

    Gift cards are not currently available for purchase or redemption through the Joseph Ribkoff online store. Joseph Ribkoff reserves the right to introduce gift card services in the future, at which time additional terms and conditions may apply. 

  18. Website Use

    The website is provided for personal and non-commercial use. Customers and visitors agree not to use the website for any unlawful, fraudulent, abusive, harmful or unauthorized purpose. 

    Users must not interfere with the operation of the website, attempt to gain unauthorized access to systems or data, introduce viruses or harmful code, scrape or copy website content in an unauthorized manner, use automated tools to manipulate the website or use the website in a way that could damage Joseph Ribkoff, customers, partners or service providers. 

    Joseph Ribkoff reserves the right to monitor website activity and take measures to protect the website, customers, systems and business operations, including limiting access, blocking suspicious activity or suspending accounts where appropriate. 

  19. Intellectual Property

    All content available on the website, including trademarks, logos, product names, photographs, videos, graphics, text, designs, layout, icons, software and other materials, is owned by or licensed to Joseph Ribkoff and is protected by applicable intellectual property laws. 

    Nothing in these Terms grants customers or website users any right, title or interest in Joseph Ribkoff’s intellectual property or in the intellectual property of third parties displayed on the website. 

    No website content may be copied, reproduced, distributed, modified, displayed, sold, licensed, used for commercial purposes or otherwise exploited without Joseph Ribkoff’s prior written authorization. 

    Unauthorized use of Joseph Ribkoff trademarks, product images, brand assets or other intellectual property may result in legal action. 

  20. User-Submitted Content

    Customers may have the ability to submit reviews, comments, feedback, photos, questions, survey responses or other content through the website, customer service channels, social media or other approved channels. 

    By submitting content, the customer represents that the content is accurate, lawful, not misleading, does not infringe third-party rights and does not contain abusive, defamatory, obscene, discriminatory, hateful, harmful or unlawful material. 

    Unless otherwise stated in a specific campaign or submission process, the customer grants Joseph Ribkoff a non-exclusive right to use, reproduce, display, adapt and distribute submitted content for business purposes, including customer service, product improvement, website display and marketing, subject to applicable law and privacy requirements. 

    Joseph Ribkoff may remove or refuse to publish submitted content at its discretion where the content violates these Terms, applicable policies or the law.

  21. Privacy

    Joseph Ribkoff collects and processes personal information in accordance with its Privacy Policy. Personal information may be collected when customers browse the website, create an account, place an order, contact Customer Care, initiate a return, subscribe to marketing communications or otherwise interact with the website. 

    Personal information may be used to process orders, provide customer service, manage shipping and returns, process refunds, detect and prevent fraud, improve website performance, personalize the customer experience, send marketing communications where consent has been provided and comply with legal and regulatory obligations. 

    Personal information may be shared with service providers and partners that support the operation of the website and DTC business, including eCommerce platform providers, Merchant of Record providers, payment processors, logistics providers, customer service platforms, analytics providers, marketing providers and other authorized third parties. 

    Customers should review the Privacy Policy for more information about how personal information is collected, used, disclosed, retained and protected, and about the rights available to customers under applicable privacy laws. 

  22. Cookies and Tracking Technologies

    The website uses cookies and similar tracking technologies to enable website functionality, remember customer preferences, support checkout, improve website performance, analyze traffic, personalize content, measure marketing performance and support advertising activities. 

    Customers may be able to manage cookie preferences through the Cookie Preference Center, subject to availability by market and applicable law.

    Third-party providers may process customer information only as needed to provide their services, support transactions, comply with legal obligations or as otherwise described in the Privacy Policy.

    The planned technology landscape may evolve before or after launch. Joseph Ribkoff may add, remove or replace service providers as required to support website operations, customer experience, compliance, security or business needs.

    Where third-party terms apply, customers may be presented with those terms during checkout or when using the relevant service.

  24. Third-Party Links

    The website may contain links to third-party websites, services or resources. These links are provided for convenience only. 

    Joseph Ribkoff does not control and is not responsible for third-party websites, their content, availability, security, privacy practices, terms of use or services. 

    Customers access third-party websites at their own risk and should review the applicable third-party terms and privacy policies. 

  25. Disclaimer of Warranties

    Except as required by applicable law, the website, its content and all services made available through the website are provided on an "as is" and "as available" basis. 

    Joseph Ribkoff does not guarantee that the website will be uninterrupted, error-free, secure, free from viruses or harmful components, or that defects will be corrected. 

    Nothing in these Terms limits any mandatory consumer rights, statutory guarantees or product warranties that cannot legally be excluded or restricted.

  26. Limitation of Liability

    To the fullest extent permitted by applicable law, Joseph Ribkoff shall not be liable for indirect, incidental, special, punitive, exemplary or consequential damages arising from or related to use of the website, inability to use the website, product availability, order processing, delivery delays, reliance on website content or purchase of products. 

    Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for death or personal injury where applicable. 

    Where limitations of liability are restricted by mandatory consumer protection laws, the limitations in these Terms will apply only to the maximum extent permitted by law. 

  27. Force Majeure

    Joseph Ribkoff shall not be responsible for delays, failure to perform or inability to fulfill obligations caused by events beyond its reasonable control. 

    Such events may include natural disasters, extreme weather, fire, flood, labour disruptions, carrier delays, customs delays, supply chain disruptions, system outages, cyber incidents, governmental actions, public health events, war, civil unrest, acts of terrorism or other circumstances beyond reasonable control. 

    Where a force majeure event affects order fulfillment or service availability, Joseph Ribkoff will take reasonable steps to manage customer impacts where commercially reasonable and legally required.

  28. Governing Law and Jurisdiction

    These Terms shall be governed by the laws of the Province of Quebec and the applicable federal laws of Canada, unless otherwise required by mandatory consumer protection laws applicable in the customer’s country, state, province or jurisdiction of residence. 

    Nothing in these Terms limits any mandatory consumer rights available to customers under applicable local law. 

    Any dispute resolution, forum selection or jurisdiction wording should be confirmed by Legal based on the final market scope and consumer law requirements.

  29. Language

    These Terms and Conditions may be translated into other languages for your convenience. In the event of any inconsistency or conflict between the English version and a translated version, the English version shall prevail, except where applicable local consumer protection laws require that the local language version govern.

  30. Changes to These Terms

    Joseph Ribkoff may update or modify these Terms from time to time. Updated Terms will become effective when published on the website, unless otherwise stated or required by applicable law. 

    The version of the Terms in effect at the time an order is placed will govern that order, unless otherwise required by applicable law. 

    Customers are encouraged to review the Terms before placing an order.
